Terms of Service

1. Agreement to Terms

By accessing or using Fact Check's website and Chrome extension (the "Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Fact Check provides a fact-checking and research tool that allows users to verify information and access reliable sources.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription Terms

Fact Check offers subscription plans with different features and pricing. By subscribing to a premium plan, you agree to the following:

  • You authorize us to charge your payment method on a recurring basis for subscription fees
  • Subscription fees are billed in advance and are non-refundable
  • You can cancel your subscription at any time through your account settings
  • After cancellation, your subscription will remain active until the end of the current billing period
  • We reserve the right to change subscription fees upon notice
  • Lifetime subscriptions provide access to premium features for the lifetime of the Service

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Fact Check and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without our prior written consent.

6. User Content

You retain ownership of any content you submit to the Service. By providing content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute it in connection with the Service.

7. Prohibited Uses

You agree not to use the Service:

  • In any way that violates any applicable law or regulation
  • To impersonate or attempt to impersonate Fact Check, an employee, or another user
  • To engage in any conduct that restricts or inhibits anyone's use of the Service
  • To attempt to gain unauthorized access to the Service or related systems
  • To use the Service for commercial purposes without our prior written consent
  • To automate or programmatically use the Service beyond normal user interactions

8. Fact-Checking Accuracy Disclaimer

Fact Check aggregates information from multiple sources and provides summaries for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of any information provided through the Service. Fact-checking results are generated using automated processes and may contain errors. You acknowledge that:

  • The Service provides information from third-party sources over which we have no control
  • Fact-checking results should not be your sole basis for important decisions
  • You are responsible for verifying critical information independently
  • We are not liable for decisions made based on information provided by the Service

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Fact Check makes no warranties, expressed or implied, regarding the accuracy, reliability, or completeness of information provided through the Service. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, Fact Check shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability to you for any claims arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $50, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Fact Check and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service, violation of these Terms, or violation of any rights of another party.

12. Refund and Cancellation Policy

All refunds are provided solely at our discretion. By purchasing a subscription or lifetime membership, you acknowledge that refunds are not guaranteed and will be evaluated on a case-by-case basis.

Refund and cancellation terms:

  • Monthly subscriptions may be cancelled at any time, with service continuing until the end of the current billing period. Refunds for monthly subscriptions are not typically provided, and any refund requests are at our sole discretion.
  • Lifetime subscriptions are final sale and non-refundable. "Lifetime" means the operational lifetime of the Service as offered by Fact Check, not your personal lifetime. We reserve the right to discontinue the Service or certain features at any time. No refunds will be provided for lifetime subscriptions under any circumstances.
  • Refund requests for technical issues or other reasons must be submitted within 30 days of purchase and will be evaluated at our sole discretion. We are not obligated to provide any refund, regardless of the circumstances.
  • If you dispute a charge with your payment provider (chargeback), we reserve the right to immediately suspend or terminate your account, and you forfeit any right to a refund.
  • All decisions regarding refunds are final and at the sole discretion of Fact Check. We reserve the right to refuse any refund request for any reason.

13. Third-Party Services and Content

The Service may contain links to third-party websites or integrate with third-party services (including but not limited to Google OAuth). We do not endorse or assume responsibility for any third-party content, services, or practices. Your use of third-party services is subject to their respective terms and privacy policies.

14. Service Modifications and Availability

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee that the Service will be available at all times or that it will be free from errors, viruses, or other harmful components. We may perform scheduled or unscheduled maintenance that may temporarily interrupt service.

15. Age Restrictions

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you are at least 16 years old. If you are under 16, you may not use the Service, and we will delete any information we discover was provided by a user under 16.

16. Account Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • You will not be entitled to any refund for unused subscription time
  • We may delete your account and associated data, subject to our Privacy Policy
  • You may request data export before termination, which we will provide within 30 days

17. Dispute Resolution

For any dispute arising from these Terms or your use of the Service, you agree to first contact us at dylan@chromefactcheck.com to attempt to resolve the dispute informally. If we cannot resolve the dispute within 60 days, you agree that any legal action or proceeding shall be brought exclusively in the courts of the United Kingdom, and you consent to the jurisdiction of such courts.

18. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, internet or telecommunications failures, or government actions.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fact Check regarding the Service and supersede all prior agreements and understandings, whether written or oral.

21. Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Fact Check.

22. Governing Law

These Terms shall be governed by the laws of the United Kingdom, without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to or use of the Service shall be instituted in the courts of the United Kingdom.

23. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
